This website (the “Site”) is operated by Lumina Sky Consulting (“Lumina Sky,” “we,” “us,” or “our”). We provide information about our consulting services for emissions reduction, regulatory interpretation, and LDAR program design.
 

2 Acceptance of these Terms


By accessing or using the Site, you agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree, do not use the Site.

We may update these Terms from time to time. The “Last updated” date reflects the most recent changes. Continued use of the Site constitutes acceptance of the revised Terms.

5 Separate agreements control services


Any consulting services are governed by a separate master services agreement, statement of work, or written proposal (collectively, “Service Agreements”). If there is a conflict between these Terms and a Service Agreement, the Service Agreement controls for the covered services.
 

6 Eligibility


You must be at least the age of majority where you live to use the Site.
 

7 Acceptable use
 

You agree not to:
 

  • Use the Site in any unlawful or harmful manner or to violate others’ rights.

  • Copy, scrape, spider, harvest, or reverse‑engineer the Site or its code except as permitted by law.

  • Introduce malware or attempt to gain unauthorized access to systems.

  • Use the Site to send unsolicited or commercial messages not expressly permitted.


8 Accounts and submissions

TO THE FULLEST EXTENT PERMITTED BY LAW, LUMINA SKY AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED USD $100.
 

14 Indemnification


You agree to defend, indemnify, and hold harmless Lumina Sky and our personnel from and against any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or violation of these Terms.
 

15 Governing law; venue


These Terms are governed by the laws of the United States and the laws of the state in which Lumina Sky maintains its principal place of business, without regard to conflict‑of‑laws rules. You agree to the exclusive jurisdiction and venue of the courts located there for any dispute not subject to informal resolution.
 

16 Dispute resolution


Before filing a claim, the parties will attempt to resolve disputes in good faith within 30 days after written notice. Nothing precludes either party from seeking injunctive or equitable relief.
 

17 Termination


We may suspend or terminate your access to the Site at any time, with or without notice, for any reason. The provisions of these Terms that by their nature should survive termination will survive (including IP, disclaimers, limitations of liability, indemnification, and governing law).
